Filing a DMCA Copyright Infringement Notice

Incomplete or Invalid Notices

Important: We can only process DMCA notices that contain ALL required elements listed above.

If your notice is incomplete:

  • We will notify you that additional information is required
  • We will provide specific details about what information is missing
  • The notice will not be processed until complete
  • The takedown will not occur until we receive a valid, complete notice

False or Fraudulent Notices:

  • Submitting false or fraudulent DMCA notices may result in legal liability

Our Response to DMCA Notices

Upon receipt of a valid and complete DMCA notice, we will:

Step 1: Review (Within 24-48 Hours)

  • Verify the notice contains all required elements
  • Assess whether the claim appears valid on its face
  • Confirm the identified material is actually on our website

Step 2: Takedown Action (If Valid)

  • Remove or disable access to the allegedly infringing material
  • Make reasonable efforts to notify the user who posted the content
  • Provide the user with a copy of the DMCA notice (with personal contact information redacted for privacy)
  • Inform the user of their right to file a counter-notification

Step 3: Documentation

  • Maintain records of all DMCA notices and actions taken
  • Document the date and time of removal
  • Preserve information for potential legal proceedings

Step 4: Follow-Up Communication

  • Confirm takedown action to the copyright holder
  • Provide notice to affected users
  • Monitor for repeat infringement by the same user

Timing: We aim to complete the takedown process within 1-3 business days of receiving a valid notice.


Counter-Notification Procedure

If you believe that material you posted on www.petzvibes.com was removed or disabled due to a mistake or misidentification, you may file a DMCA counter-notification.

Requirements for a Valid Counter-Notification:

Processing Counter-Notifications

Upon receipt of a valid counter-notification:

Step 1: Review (Within 2-3 Business Days)

  • Verify the counter-notification contains all required elements
  • Check that it meets DMCA legal requirements
  • Confirm the identity of the person filing

Step 2: Forward to Original Complainant (Within 2-3 Business Days)

  • Send a copy of the counter-notification to the person who filed the original DMCA notice
  • Notify them that we will restore the removed content in 10-14 business days
  • Inform them of their right to file a court action

Step 3: Wait Period (10-14 Business Days)

  • Allow time for the copyright holder to file a court action
  • Monitor for notification of legal proceedings
  • Maintain removed content status during this period

Step 4: Restoration (If No Court Action Filed)

  • Restore the removed material if no court action is filed within 10-14 business days
  • Notify the user that their content has been restored
  • Document the restoration

Exception: If the original complainant files a lawsuit and provides proof, the material will remain removed pending court resolution.


Repeat Infringer Policy

In accordance with the DMCA and to maintain our safe harbor protections, PetzVibes has adopted and implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

What Constitutes a Repeat Infringer:

Repeat Infringer Definition:

  • A user who has received two or more valid DMCA notices
  • A user who repeatedly posts infringing content after being warned
  • A user whose content has been removed multiple times for copyright violation

Actions We Take:

First Infringement:

  • Remove infringing content
  • Send warning email to user
  • Educate about copyright law and our policies
  • Document the violation

Second Infringement:

  • Remove infringing content
  • Send final warning email
  • Temporarily suspend account (if applicable)
  • Place account under monitoring

Third Infringement:

  • Permanent account termination
  • Remove all user content
  • Ban IP address and email (if necessary)
  • Report to authorities if warranted

Fair Use Considerations

shall be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by the copyright owner or licensee, or by the service provider.

What This Means:

  • Do not file notices for strategic or competitive purposes
  • Do not file notices without reviewing the allegedly infringing content
  • Be truthful in all statements

For Users Filing Counter-Notifications:

  • Do not file counter-notifications for content you know is infringing
  • Do not file counter-notifications without good faith belief
  • Be honest about ownership and rights
  • Understand the legal consequences of false claims

Criminal Penalties:

Under 18 U.S.C. § 1621, perjury in DMCA notices is a criminal offense punishable by fine and/or imprisonment.
